Overview

This notice explains how Vertrage LLC ("Vertrage", "we", "us") handles personal data. It covers two different situations: personal data we collect when you visit vertrage.com, and personal data contained in documents our clients upload to the Vertrage platform. Our role, and your route to exercising your rights, differs between the two, so each is described separately below.

Part 1: When you visit our website

What we collect. If you accept analytics cookies, we use Google Analytics, which collects the pages you visit and time spent on them, how you arrived at the site, general location at city or country level, device type, browser and operating system, and your IP address in anonymized form. If you decline, these cookies are not set and this data is not collected.

If you contact us through the site, we collect the name, email address, and any other details you choose to provide in your message.

Why we use it, and our legal basis. We use analytics data to understand how visitors use the site and to improve it. Our legal basis is your consent, which you give through the cookie banner and can withdraw at any time. We use contact form details to respond to your enquiry. Our legal basis is our legitimate interest in responding to people who contact us, and, where relevant, taking steps at your request before entering into a contract.

How long we keep it. Analytics data is retained for 14 months. Enquiry correspondence is retained for as long as needed to deal with your enquiry and our ongoing business relationship.

Who receives it. Google LLC provides Google Analytics and processes analytics data on our behalf. Google LLC also provides the business email service through which we receive enquiries. Microsoft Corporation provides document and storage services. We do not sell or rent personal data, and we do not share it with third parties for their own marketing.

International transfers. Vertrage is established in the United States, and these providers may process data outside the European Economic Area. Where personal data is transferred out of the EEA, the transfer is covered by appropriate safeguards, principally the European Commission's Standard Contractual Clauses.

Part 2: Personal data in client documents

Our clients use the Vertrage platform to analyze construction change orders and related project records. Those documents can contain personal data about individuals involved in a project, such as names, signatures, job titles, and business contact details.

For that data, our client is the data controller and Vertrage is a data processor. This means the client decides what is processed and why, and we act only on that client's documented instructions, under a written data processing agreement. We do not use personal data in client documents for any purpose of our own, and we do not use it to train artificial intelligence models.

If you believe your personal data appears in documents held on the Vertrage platform and you want to exercise your rights, the organization that engaged us is the right party to contact, because it controls that data. If you contact us instead, we will pass your request to the relevant client without undue delay and support them in responding.

Your rights

Where we act as a controller, which for the purposes of this notice means the website activities in Part 1, you have the right to:

  • request access to the personal data we hold about you
  • ask us to correct data that is inaccurate or incomplete
  • ask us to delete your data
  • ask us to restrict how we use your data
  • object to processing that we carry out on the basis of legitimate interests
  • receive data you gave us in a structured, commonly used, machine-readable format, and ask us to transfer it to another organization, where the processing is based on consent or a contract and is carried out by automated means
  • withdraw your consent at any time, without affecting processing carried out before you withdrew it

To exercise any of these rights, contact us at contact@vertrage.com. We will respond within one month. There is no charge for making a request.

You also have the right to complain to a data protection supervisory authority. If you are in the European Economic Area, you may complain to the authority in the country where you live or work.

Automated decision-making

We do not make decisions producing legal effects, or similarly significant effects, about individuals by automated means. The Vertrage platform produces analysis and recommendations that a person reviews before any decision is taken.

Cookies

We use cookies that are strictly necessary for the site to function, which do not require your consent. We use Google Analytics cookies only if you accept them through the cookie banner. You can change or withdraw your choice at any time using the link in the footer, and you can also block or delete cookies through your browser settings.

Changes to this notice

We may update this notice. When we do, we will change the "last updated" date at the top of this page and, where the change is significant, we will draw attention to it on the site.
